26. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.

Products

27. We make every effort to display as accurately as possible the colours, features, specifications and details of products available on this website. However we do not guarantee that the colours, shapes, features, specifications and details of the products will be accurate, complete, reliable, current or free of errors, or that your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee items will be in stock. We reserve the right to discontinue any products at any time. All prices for all products are subject to change.

28. For bespoke orders and services, we will do our best to fulfil requests for specific colours and flowers, however we are subject to the seasons and the British weather. Crops grow, succeed, and fail in their own time. If a replacement flower happens to be needed, we will replace with the closest possible option of the same or higher value.

29. We cannot accept liability for deterioration in the condition of your flowers or floral arrangements whilst in transit or care in home.

30. Our flowers should not be eaten under any circumstances unless they have been explicitly marked as edible. We cannot take any responsibility for reactions to our produce i.e relating to personal allergies or intolerances.

31. We cannot be held responsible for any damage associated with our products including but not limited to pollen, water or candle wax

32. We only post/deliver to UK addresses subject to courier coverage

33. For bespoke fresh flower orders, we require a minimum of 24 hours’ notice (delivered on Thursdays). We currently hand-deliver, contact-free to the following postcodes: BA1, BA2, BA3, BA4, BA5, BA6, BA15 BA16, TA11. Our delivery window is scheduled at 8am to 3pm each Thursday. If you would like us to deliver outside of these area codes or times, please contact us and we will see if we can accommodate. We will always try to deliver directly to the recipient. If the recipient is not scheduled to be at the given address at the agreed delivery time, please make sure you provide us with details of a safe, dry space for the bouquet to be placed. This is at the customer’s own risk. We cannot deliver to incomplete addresses and cannot take responsibility for incorrect details leading to an unfulfilled delivery. If delivering to a commercial address, please check that the flowers can be delivered to the address and provide delivery instructions. We cannot accept responsibility for failure of receptions or postal rooms to pass on the flowers.

Payments

34. We accept card payments for products sold directly through this website only. For bespoke services such as weddings and installations, we can only accept bank transfers based on payment terms that are agreed on a project-by-project basis.

35. You agree to provide current, complete and accurate purchase and account information, including email address, phone number, payment method and card details, so that we can complete your transactions and contact you as needed. Prices may change at any time.

36 All payments shall be made in GBP.

37.You agree to pay all charges at the prices then in effect of your purchases and any applicable shipping fees, and you authorise us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

38. We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

Returns policy

We hope that you enjoy the purchases you make within the shop section of this website, from Sula Jones trading as Nice Bunch. However, if you wish to return an item, you may do so in accordance with your statutory rights or in accordance with this Returns Policy. Note that bespoke weddings and installations are exempt from these terms.

How to Return an Item 

As an alternative to the return options provided by your statutory rights, customers may return items purchased from the shop section of this website, Sula Jones trading as Nice Bunch, under this Returns Policy in accordance with the following terms:

1.   Returns made under this Returns Policy must be made within 14 days of delivery of an item.

2.   Items to be returned must:

a.   Be in perfect condition.

b.   Be in its original packaging.

c.   Still have tags attached, where applicable.

d. Not be floral arrangements. They are a bespoke-made and a perishable item. Should you have any issues relating to damage, quality, shape, size or quantity of your flowers, you must notify us on the day of receipt. Complaints will not be accepted after the day of delivery. We reserve the right to rectify any issues on the day without prejudice.

3.   To start the returns process, you should email us at sula@nicebunch.shop requesting a return in accordance with this Returns Policy. Include your name, identification of your order (e.g. an order number), and details of the item(s) you want to return. 

Entitlement to a Refund

When a return is made following the requirements and procedures set out in this Returns Policy, a customer is entitled to a refund of the price you paid for the item(s): 

1.   Taking into account any discounts that were applied at the time of purchase.

2.   Exclusive of any shipping costs paid.

Processing Returns

Once we have received an item you wish to return:  

1.   We will check the item you have returned within, wherever possible, 14 days.

2.   If we confirm that the item and your returns procedure comply with the requirements set out in this Returns Policy: 

a.   We will let you know that your return has been received and accepted. 

b.   You will receive a refund via your original payment method, usually within 14 days of a return being accepted. Or, if an exchange is available and agreed to instead, your new item will be delivered to you within our usual delivery timeframes.

3.   If the item returned or your returns procedure does not comply with the requirements set out in this Returns Policy:

a.   We will let you know why your return has not been accepted. 

b.   We may offer a reduced refund (e.g. if an item is returned damaged).

c.   You will have the option to take the item back (note that you may be required to pay for shipping if necessary).

Exchanges

If you wish to exchange an item purchased for another item (e.g. the same product in a different size or colour), you should return the purchased item as usual (i.e. as set out above) and, during the returns process, indicate your wish to exchange your item for a new item and specify exactly which item you wish to exchange for.

Floral arrangements are bespoke-made and a perishable item. Should you have any issues relating to damage, quality, shape, size or quantity of your flowers, you must notify us on the day of receipt. Complaints will not be accepted after the day of delivery and we won’t exchange for a new item beyond this point. We reserve the right to rectify any issues on the day without prejudice.

Then: 

1.   If the requested exchange is possible, we will send the new item to you once the item being returned has been received.

2.   If the requested exchange is not possible (e.g. because the requested item is not in stock or has a different price), we will inform you of this and provide a refund instead. You may then choose to purchase an alternative item from us by starting a new purchase.

A Customer’s Statutory Rights 

The returns process provided under this Returns Policy is provided in addition to customers’ statutory rights and this Returns Policy does not diminish these statutory rights in any way - it simply provides our customers with an additional returns option.
